Subject: Filling up of one post of Additional Director (Prosecution) in the Directorate of Enforcement on deputation basis-reg
Applications are invited from eligible officers for filling up of one vacant post of Additional Director (Prosecution) in the pay scale of Rs. 14,300-18,300/ (pre-revised) in the Directorate of Enforcement, New Delhi, under the Ministry of Finance, Department of Revenue on deputation basis.
2. The following categories of Officers are eligible:
Officers under the Central Government or the State Government/UTs:
(a) (i) Holding analogous post on regular basis in the parent cadre/department or
(ii) With 5 years service in the grade rendered after appointment thereto on a regular basis in the scale of pay Rs.12,000-16,500/-or equivalent in the parent cadre/department; and
(b) possessing the following educational qualifications and experience:
(i) Degree in Law from a recognized University or equivalent;
(ii) 12 years experience relating to fiscal / criminal Laws.
3. The period of deputation including period of deputation in another ex-cadre post held immediately preceding this appointment in the same organization or department shall ordinarily not exceed 4 years.
4. The duties of the Additional Director (Prosecution) are to process cases for filing prosecution against Prevention of Money Laundering Act (PMLA),2002 offenders, to advise zonal/sub-zonal offices of the Directorate on legal matters relating to Foreign Exchange Regulation Act (FERA),1973, Foreign Exchange Management Act (FEMA),1999, PMLA when called upon to do so; to present cases on behalf of the Directorate of Enforcement before the Appellate Tribunal for Foreign Exchange (ATFE), the Special Director (Appeal) and the Adjudicating Authority and Appellate Authority (constituted under PMLA); to supervise the matters pending before High Courts and Lower Courts and to prepare para-wise comments and prepare affidavit/ counter affidavit in consultation with Govt. counsel and to review Adjudication orders. In addition, he shall also perform such functions as are prescribed under the PMLA Manual of the Directorate of Enforcement.

5. The pay and allowances and other terms and conditions will be regulated in accordance with the Department of Personnel & Training’s OM No. 2/29/91 Estt (Pay-II) dated 5-1-94, as amended from time to time.
6 The Cadre Controlling Authorities are requested to forward applications of the eligible and willing Officers in the proforma given as Annexure ‘A’ so as to reach to the Under Secretary, Room No.55, Ministry of Finance. Department of Revenue, North Block, New Delhi -110001 within 45 days from the date of publication of this advertisement.
7. While forwarding the applications, the Cadre Controlling Authorities may please verify that the particulars furnished by the applicant are correct and that no disciplinary case is either pending or contemplated against him. Accordingly, the following documents should be sent by the Cadre Controlling Authority along with the application:-
(i) Two copies of bio data
(ii) Complete and up-to-date C.R.dossiers for the last five years upto 2008-2009 or attested photocopy thereof
(iii) Vigilance Certificate /Clearance
(iv) Integrity Certificate/Clearance
(v) Cadre Clearance
(vi) A statement of major/minor penalties, if any, imposed upon the officer during the last 10 years
8. Incomplete applications or applications not received through proper channel will not be entertained and will be rejected.
9. The candidates will not be allowed to the withdraw their candidature subsequently on any ground.
